Is this your procedure?

It is for you if…

  • Spouse over 18 of a Spanish national, if there is no annulment or divorce (art. 94.1.a).
  • Partner over 18 registered in a public register of an EU country, the EEA (European Economic Area) or Switzerland (art. 94.1.b).
  • Unregistered stable partner who can prove at least 12 continuous months of living together, or who has children in common (art. 94.1.c).
  • Sons and daughters of the Spanish national or of their partner, under 26, or older and dependent or with a disability that needs support, if they have not married or started their own family (art. 94.1.d).
  • Father and mother of the Spanish national or of their partner, if they are dependent on them and have no family support in their country, or on humanitarian grounds (art. 94.1.e).
  • Father, mother or guardian of a Spanish child, if the child is in their care and lives with them, or they meet their obligations towards the child (art. 94.1.f).
  • A family member, up to the second degree, who cares for a Spanish national with a recognised degree of dependency (art. 94.1.g).
  • Sons and daughters of a father or mother who is or was Spanish by origin (art. 94.1.h).
  • Other family members who show that they are dependent on the Spanish national (art. 94.1.i). They cannot apply from inside Spain (art. 97.1.c).

It is not for you if…

  • Your family member has the nationality of another EU or EEA country or Switzerland, not Spanish nationality: your procedure is the EU family member card.

See: Family of an EU citizen
  • You are the father, mother or guardian of a child from another EU or EEA country or Switzerland: your route is family arraigo.

    See: Family arraigo
  • You also have the nationality of an EU or EEA country or Switzerland: you need the EU registration certificate.

    See: EU registration certificate
  • Your family member is a foreign national with residence in Spain, not a Spanish national: the route is family reunification.

    See: Family reunification

If you were looking for…

«family arraigo through a son, daughter or spouse who is Spanish»
Since 20 May 2025, family arraigo is no longer the route for family members of Spanish nationals: it is now this authorisation (arts. 93-99 of RD 1155/2024). If on 20 May 2025 you held a valid family arraigo through a tie with a Spanish national, you keep your residence as long as you meet the conditions (third transitional provision of RD 1155/2024).
«tarjeta comunitaria for a family member of a Spanish national»
For new applications, family members of Spanish nationals apply for this authorisation with form EX-24. There is one exception: if your Spanish family member has exercised the right to free movement in the EU, you can still take the EU route with form EX-19. Anyone who on 20 May 2025 held a valid tarjeta comunitaria through a tie with a Spanish national keeps their residence as long as they meet the conditions (third transitional provision of RD 1155/2024).

How to apply depending on where each of you is

  • You and your Spanish family member in Spain. Either of you submits the application at the Immigration Office (Oficina de Extranjería) of the province (art. 97.1.c). This applies to the ties in letters a) to h) of art. 94.1.
  • Your Spanish family member in Spain and you abroad. Your family member submits the application here. If it is granted, you apply for the visa at the Spanish consulate within 1 month (arts. 97.1.a and 41.2).
  • Both of you outside Spain. You apply for the visa at the Spanish consulate, and the authorisation is processed with it (arts. 97.1.b and 41.3).

In all three cases, fingerprinting for the TIE is done in person: there is no way to do it remotely.

Requirements

  • Not have the nationality of an EU or EEA country or Switzerland.

    RD 1155/2024, art. 93

  • Have one of the listed ties with the Spanish national and live with them, or come to join them in Spain.

    RD 1155/2024, arts. 93 and 94.1

  • Prove the tie with documents: marriage certificate, partnership registration certificate or birth certificate.

    RD 1155/2024, art. 96.b.2nd

  • Unregistered stable partner: prove at least 12 continuous months of living together, in or outside Spain. This is not needed if you have children in common and the relationship continues.

    RD 1155/2024, art. 94.1.c

  • If your tie requires it (children aged 26 or over, parents, other family members), show that you are dependent on the Spanish national: real, stable financial support from before the application. If you are the father or mother and are already in Spain, it is no longer required that this dependency arose in your country of origin.

    RD 1155/2024, arts. 94.3 and 196.2; STS 868/2026, ruling 2(c)

  • Father, mother or guardian of a Spanish child: have the child in your care and live with them, or be up to date with your obligations. The Supreme Court annulled the requirement that this relationship must have been established under Spanish law.

    RD 1155/2024, art. 94.1.f; STS 868/2026, ruling 2(b)

  • Criminal record. General rule: a previous conviction does not on its own lead to refusal; your personal conduct is assessed. But the unregistered stable partner, the caring family member, the children of a Spaniard by origin and the other dependent family members must prove that they have no criminal record. And if you apply from inside Spain, you must have no criminal record in the countries where you lived in the last 5 years. In 2026 the Supreme Court annulled that automatic refusal, without individual assessment, only in cases under art. 20 of the Treaty on the Functioning of the EU (TFEU). Outside those cases, a criminal record can be grounds for refusal.

    RD 1155/2024, arts. 38.e, 97.4 and 98.1; STS 868/2026, ruling 2(d)

  • If you apply for the authorisation from inside Spain, you do not need to already hold a residence authorisation.

    RD 1155/2024, art. 97.4 (excludes art. 38.b)

Documents

Guide list only. Before we start, we tell you exactly which ones you need in your case.

  • Form EX-24, filled in and signed.
  • The foreign family member's full valid passport (copy of every page).
  • The Spanish national's valid DNI (Spanish national identity card) or passport.
  • Document proving the tie: marriage certificate, partnership registration certificate or birth certificate.

  • If being dependent is required: proof of financial dependency, for example regular money transfers.
  • Spouse or partner: a responsible declaration (declaración responsable) by the Spanish national that they do not live in Spain with another spouse or partner.
  • Proof that you live together, for example the padrón (your town hall's register of residents) showing the same address.
  • If you are an adult and lived outside Spain in the last 5 years: criminal record certificate from those countries.
  • Foreign documents translated into Spanish and legalised or apostilled, if needed.

Please don't send documents on WhatsApp or by email. If we need any, we'll give you a secure way to send them.

Deadlines

When to apply
There is no fixed window for the first application. If you apply from inside Spain, from the moment it is accepted for processing you can live and work on a provisional basis, unless an identical application was refused before on the same facts (art. 97.5).
Time limit for a decision
The Immigration Office has 2 months. If it does not reply within that time, the application is deemed refused and you can appeal (art. 97.6).
If a document is missing
You get up to 15 days to provide it. If you do not, the application is closed (art. 97.6).
Card (TIE)
Once the authorisation is granted, apply for the TIE (foreigner identity card) in person at the police station within 1 month of the notification, or of your entry into Spain if you come with a visa. Fingerprinting is done in person (art. 97.7).
Renewal
If it was granted for less than 5 years, it is renewed in the 2 months before it expires or in the 3 months after (art. 95.4).
Changes you must report
Changes of address, nationality, marital status or partner: within 2 months, to the Immigration Office or the police station (art. 98.2).

  3. 3. We prepare your application file

We review your documents and make sure the file is complete and well explained. Once we have everything, we tell you the date it will be ready.

Online submission on your behalf when the procedure allows it.

  4. 4. Follow-up and an update on every development

We follow your file until the decision. If the authorities ask for anything else, we prepare it with you.

Fingerprinting for the TIE is done in person, by you: that part is yours.

In Barcelona and Catalonia

It is a national (state) procedure: the Generalitat (the Catalan government) is not involved. In the province of Barcelona the application goes to the Immigration Office and the TIE is requested in person at a Policía Nacional (national police) station, with the appointment (cita previa) you book yourself.

Frequently asked questions

Can I apply from inside Spain even if I do not yet have a residence authorisation?

Yes, as long as your Spanish family member is also in Spain and your tie is one of those in letters a) to h) of art. 94.1 (art. 97.1.c, as worded by RD 316/2026). You do not need to already hold an authorisation (art. 97.4). From the moment it is accepted for processing you can live and work on a provisional basis (art. 97.5).

My son is 20. Can he apply from inside Spain?

Yes. Since 16 April 2026, children under 26, and older children who are dependent or have a disability that needs support, can apply from inside Spain if they have not married or started their own family (arts. 94.1.d and 97.1.c).

Does my Spanish family member have to show income?

Not in general: the requirements in arts. 94 to 96 do not ask for minimum income or health insurance. Only if your tie requires you to be dependent on the Spanish national do you need to prove that financial dependency; in that case, whether your Spanish family member has the means to support you is also assessed (art. 196.3.d).

Is there a government fee for the authorisation?

The application for the authorisation has no fee (art. 97.8 of RD 1155/2024). You do pay the fee for the TIE, which is the same amount as the fee for the DNI (art. 1.3 of Order PJC/617/2025). You can see the breakdown in the price box.

I have a tarjeta comunitaria through my Spanish partner, valid on 20 May 2025. Do I have to apply for this authorisation?

You do not need to: you keep your residence as long as you meet the conditions of arts. 93-99 (third transitional provision of RD 1155/2024). When your card is close to expiring, it is a good idea to check what applies to you.

What happens if we divorce or my Spanish family member dies?

You can keep your residence in your own right in some cases: marriage or partnership of at least 3 years (1 in Spain), custody of or visits with the children, gender-based violence or death. You must report it and apply for independent residence within the following 6 months. Unregistered stable partners and other dependent family members do not have this option (art. 99).
