Withdrawing from a contract
Anyone who enters into a distance contract as a consumer has 14 calendar days to withdraw from it, without giving any reason. A clear statement sent before the period ends is enough. Here is the model form set out in the law, ready to copy.
Translation for information only. If there is any discrepancy, the Spanish version prevails.
The essentials
- Period: 14 calendar days from the day the contract is concluded (TRLGDCU, arts. 102 and 104.a).
- No reason needed and no cost, unless you asked for the service to start earlier (see below).
- How: with any clear statement. The model form is optional (art. 106.1).
- On time: it is enough to send it before the period ends (art. 106.2).
- Refund: within 14 calendar days at most, using the same payment method (art. 107.1).
How to send it
- Copy the form below and fill in the details.
- Send it to exactitudfiscal@gmail.com with the subject “Desistimiento” (Withdrawal). It can also be sent by post to the address given in the legal notice.
- If you have it, add the reference of the request or the quote. It helps to find the contract.
Un Papel Menos confirms in writing that it has received the withdrawal. It is best to send it in writing: the person withdrawing must be able to prove they did so (art. 106.4).
There is no need to attach any identity document.
If you asked for the service to start earlier
- If you expressly asked for the service to start within the 14 days, when you withdraw you only pay for the part already provided. It is calculated in proportion to the total price (art. 108.4).
- If you did not expressly ask for it, or if you were not informed of the right of withdrawal, you pay nothing for what has already been done (art. 108.5.a).
- If the service has already been fully provided, you can no longer withdraw. This only happens if it started with your express consent and in the knowledge that you would lose this right (art. 103.a).
Model withdrawal form
This is the model in Annex I, letter B, of the consolidated text of the General Law for the Protection of Consumers and Users (TRLGDCU). Its article 106.1 refers to it. You only need to fill it in and send it if you want to withdraw from the contract.
